TERMS OF USE 

     

    1. ACCEPTANCE OF THE TERMS

    These Terms of Use (“Terms”) form a legally binding agreement between you and DistressSales (“DistressSales”, “we”, “our”, “us”).
    By accessing or using the DistressSales website, mobile application, or any services provided (collectively the “Platform”), you agree to be bound by these Terms.

    If you do not agree, you must stop using the Platform immediately.

    Your use of the Platform is also governed by our Privacy Policy and any other guidelines published on the Platform.

    We may update or modify these Terms at any time, with or without notice. Your continued use of the Platform means you accept any changes.

    2. IMPORTANT DISCLAIMERS

    DistressSales provides a listing platform only. We are not:

    1. A buyer or seller
    2. A manufacturer, distributor, importer
    3. A representative or agent of any user
    4. A party to any transaction between users

    All items, services, conversations, and payments are strictly between users.

    As-Is Service

    All services on DistressSales are provided “as is”, “as available”, and without warranties of any kind.
    We do not guarantee:

    1. The quality, safety, legality, or authenticity of items listed
    2. The accuracy or truthfulness of user-provided information
    3. That a seller can sell or that a buyer can pay
    4. That a transaction will be completed
    5. That items do not infringe on rights of third parties

    You use the Platform at your own risk.

    3. SAFETY GUIDELINES FOR BUYERS & SELLERS (VERY IMPORTANT)

    DistressSales is committed to a safer buying and selling experience, but users must protect themselves.

    For Buyers

    1. Inspect items thoroughly BEFORE paying.
    2. Avoid paying before receiving the item unless you trust the seller.
    3. Meet in daylight, public places, preferably with someone you know.
    4. Request receipts, proof of ownership, or documentation if needed.
    5. Be cautious of unusually low prices (“too good to be true”).

    For Sellers

    1. Do not meet buyers in secluded or unsafe locations.
    2. Confirm payment before handing over goods.
    3. Block/report suspicious buyers.
    4. Keep records of transactions.

    DistressSales is not responsible for:

    1. Meetings
    2. Loss of money
    3. Fraud
    4. Theft
    5. Property damage
    6. Personal safety incidents

    Users interact at their own risk.

    4. ACCOUNT REGISTRATION

    To access some features, you must create a DistressSales account.

    By registering, you agree that:

    1. You will provide accurate and complete information
    2. You will maintain only one account, unless authorized
    3. You will keep your login details secure
    4. You are at least 18 years old, or using the Platform with parental guidance

    We may suspend or terminate your account if:

    1. You violate these Terms
    2. You engage in suspicious or fraudulent activities
    3. You create duplicate accounts
    4. You misuse the Platform

    You must notify us immediately of any unauthorised use of your account.

    5. PLATFORM SERVICE DESCRIPTION

    DistressSales allows users to:

    1. Post item listings
    2. Browse listings from other users
    3. Contact buyers/sellers directly
    4. Communicate using details in the listing

    DistressSales:

    1. Does not participate in transactions
    2. Does not guarantee sales or purchases
    3. Does not collect payments on your behalf
    4. Does not hold goods
    5. Does not settle disputes between users

    Users are solely responsible for taxes on goods or services sold.

    We may delete or block listings if:

    1. Required by law
    2. They violate our Terms
    3. They infringe rights of others
    4. They contain misleading or harmful content
    5. They involve prohibited items

    6. POSTING LISTINGS

    When posting items or services, you agree to:

    1. Provide accurate and complete details
    2. Use a reachable and responsive phone number
    3. Provide documentation if requested
    4. Not mislead buyers
    5. Not post prohibited items

    The price must be clear and honest.
    You agree that you have:

    1. Legal ownership of the item
    2. The right to sell or advertise it

    Listings that violate our rules may be removed without notice.

    7. FEES AND PAYMENTS

    DistressSales is generally free to use.
    However, we may offer premium/paid features such as:

    1. Boosted ads
    2. Featured listings
    3. Category-based posting limits

    Fees are non-refundable, except where required by law.

    We may change our fees or payment methods at any time.

    8. USER RULES & CONDUCT

    By using DistressSales, you agree NOT to:

    1. Post false, misleading, or deceptive information
    2. Post stolen, fake, or illegal items
    3. Promote violence, hate, or discrimination
    4. Harass or threaten other users
    5. Upload viruses, malware, or harmful software
    6. Collect user data without permission
    7. Post pornography or sexual content
    8. Promote weapons or unsafe items
    9. Post spam, chain letters, or advertising without products
    10. Mention or promote competing platforms
    11. Upload counterfeit or pirated goods

    Violation may result in account suspension or legal action.

    9. INDEMNITY

    You agree to indemnify and protect DistressSales against any claims arising from:

    1. Your use of the Platform
    2. Your listings
    3. Your interactions with other users
    4. Your violation of these Terms
    5. Your breach of law

    10. LIMITATION OF LIABILITY

    To the maximum extent allowed by law:

    DistressSales is not liable for:

    1. Lost profits
    2. Data loss
    3. Fraud by users
    4. Personal injuries
    5. Financial losses
    6. Incomplete transactions

    Our total liability is limited to:

    The lesser of:

    The amount you paid for our services in the last 6 months, OR

    • ₦30,000

    11. INTELLECTUAL PROPERTY

    You own the content you upload.

    But by posting on DistressSales, you grant us a non-exclusive, worldwide license to:

    1. Store
    2. Display
    3. Publish
    4. Modify
    5. Promote
    6. Distribute

    …the content for Platform operations and marketing.

    We do not claim ownership of your intellectual property.

    12. TERMINATION

    We may terminate or suspend your account if you violate:

    1. These Terms
    2. Applicable laws
    3. User safety
    4. Community guidelines

    You may stop using the Platform at any time.

    13. GOVERNING LAW

    These Terms are governed by the laws of the Federal Republic of Nigeria.
